Black magic and other superstitious offenses violate the fundamental rights guaranteed by Articles 14, 15, and 21 of the Indian Constitution. While about black magic, such things can not be proved in the court, as there is no substantial proof, and these things are not entertained by the court. Other than the states of Maharashtra and Karnataka, in the rest of the states/union territories, including West Bengal, where there is no special legislation to deal with the practice of black magic, any person can still lodge an FIR under Section 154 of Cr. PC to report activities related to black magic to the police to investigate. There is no exact provision of law to deal with the issue of black magic, and typically, there are no benchmark pieces of evidence to prove a complaint of black magic before the Court
