How to enforce registered will and evict uncle from grandfathers self-acquired property
My father is the youngest among four brothers. One of my uncles and his family have been living in my grandfather’s house in Dehradun for over 10 years. My grandfather passed away in 2022. He left a registered will in my mother’s name, clearly stating that none of the sons (including my father) will get any share of the property, and that none of them took care of him. The property was fully self-acquired by my grandfather. The will has not yet been probated or enforced. We have the original registered will, but the witnesses are either deceased or cannot be traced. We want to: 1) Enforce the will and obtain clear title in my mother’s name. 2) Evict my uncle and his family who are refusing to vacate. 3) Understand if probate is mandatory in Uttarakhand in this situation. 4) Know if we can file for eviction directly or must first get probate. 5) Learn how to handle the issue of deceased/unavailable witnesses during probate of a registered will. 6) Get an approximate estimate of time and cost for the entire process (probate + eviction). Please advise the correct legal procedure and any precautions we should take to avoid disputes or delays.
