Section 8(3) of the RTI Act, 2005 states that any information relating to any occurrence, event or matter which has taken place, occurred or happened twenty years before the date on which any request is made under Secton 6 shall be provided to any person making a request under that section, subject to the provisions of of exemtions specified in clauses (a), (c) and (i) of sub-section (1) of Section 8 of the Act. Even if information falls under exemptions, it can still be disclosed if the public interest in disclosure outweighs the harm that might be caused by the disclosure of such information. However, where any question arises as to the date from which the period of 20 years has to be computed, the decision of the Central Government or State Government shall be final, subject to the usual appeals provided for in the Act. According to guidlines issued by the Department of Personnel and Training, Govt. of India vide O M No.1/4/2009 dated 05/10/2009(Clause 10), a citizen has a right to seek such information from a public authority which is held by the public authority or which is held under its control. This right includes inspection of work, documents and records; taking notes, extracts or certified copies of documents or records; and taking certified samples of material held by the public authority or held under the control of the public authority. It is important to note that only such information can be supplied under the Act which already exists and is held by the public authority or held under the control of the public authority. The Central Public Information Officer(CPIO) or the State Public Information Officer(SPIO) is not supposed to create information; or to interpret information; or to solve the problems raised by the applicants; or to furnish replies to hypothetical questions. So, please be guided accordingly while seeking an information of about 48 years old from the public authority under the RTI Act.

To obtain a certified copy of the Slum Declaration Order for the land situated in Vakola, Vivekanand Nagar, Kolekalyan, Santacruz East declared a slum on 31/08/1977 and published through Government Gazette No. DC/A/ENC/4 dated 15/09/1977—you can file an RTI application with either the Public Information Officer (PIO) of the Slum Rehabilitation Authority (SRA), Bandra (East) or the Assistant Commissioner, H/East Ward Office, MCGM, Khar East, as both are competent authorities for slum-related matters in that region.

In your RTI, mention the specific land details, declaration dates, and request a certified copy of the slum declaration and gazette notification under the RTI Act, 2005, along with the applicable fee.
