You can explain to the court that although you were previously working in the Gulf and earning around ₹20 lakhs per annum, your circumstances have now significantly changed. Due to your knee injury, you have been advised by medical professionals not to resume your overseas job, as it requires physical fitness. Continuing such work in your current condition could lead to permanent damage.

You should submit medical reports and doctor's advice to support this. You can also inform the court that you have only around ₹5 lakhs in savings, as most of your past income has already been spent on family health issues, household expenses, and property-related costs.

Since you're currently unemployed and planning to seek work in India where the expected income is much lower (₹6–8 lakhs per annum), the court should be requested to consider your present earning capacity, not your past income.

If she files for interim maintenance of ₹1 lakh per month, you have the right to oppose that amount based on your current financial limitations and inability to resume high-paying employment. You can also request the court to fix a reasonable amount, if any, based on your actual situation.

Make sure to file a written objection with all supporting documents (medical proof, income details, savings proof, etc.). The court will consider your genuine hardship and not impose an amount that is beyond your current capacity.
