Buying new apartment in Co-operative Housing
Dear Sir,Buying new apartment in Co-operative Housing society thru' builder in Kolkata 1) I am going to book/buy one flat in a Co-operative housing society in Kolkata. The Society is a registered body and got the land from 'Kolkata Development Authority' for building apartments. 2) The Society has signed two agreements 'Agreement for Assignments' and 'Agreement for Constructions' to one builder though two separate 'Agreements' papers. 3) Now builder wants me to be a member of the society first, and then pay for construction of the flat in steps. For these two purposes, the builder wants me to come in a 'MOU' on a stamp paper instead of any 'Agreement'. Question: In there any legal value of the 'MOU' on a stamp paper? Should I proceed, or is there any possibility that I may not be able to go for any legal process in case of any fraud by the builder? Regards,
