Considering the complexity of your case and life threatening situation, you can file a petition praying for a protective order before the City Civil Court or District Court. A Protective Order is a civil court order that is designed to stop violent and harassing behavior and to protect you from the abuser whose attitude or behavior appears to be life-threatening. There are two types of Protective Orders available for you. 1. Emergency Order of Protection (Ex Parte Emergency Order of Protection) - The Petition for Protective Order must clearly show that an act of abuse or threat has occurred. 2. Regular Order of Protection (Non-emergency). There are no fees for filing a petition for a Protective Order. You do not need an Advocate to file for a Protective Order. However, if you wish, you can hire an Advocate to represent you suitably before the Court to obtain a protective order. At the Show Cause hearing, you have to show and prove by adducing substantial evidence why you need the Protective Order. Further, to address or resolve a false complaint or false criminal proceeding filed against you, you can seek its quashing through a petition before the High Court under Section 482 of the Code of Criminal Procedure, 1973(now Section 528 of BNSS).. The Sec. 482 Cr. PC empowers the High Court to dismiss false complaints/criminal proceedings initiated pursuant to that complaint before the trial Court against a person. It is essential to prove to the court that the complaint or criminal suit was lodged with malicious intent to cause harm or inconvenience and is devoid of truth. The burden of proof rests on the petitioner. An application for the quashing of an FIR or criminal proceedings can also be filed before the High Court under Article 226 of the Constitution of India through a Criminal Miscellaneous Writ Petition invoking the extraordinary jurisdiction of the Court to quash an FIR or criminal proceedings. An advocate has a fiduciary duty to protect the client's interests through honest and ethical means, regardless of the potential for negative outcomes for the advocate or any other parties. A litigant can add any number of advocates to represent him/her in the court, there is no limit to this. He/she can also replace his/her Advocate if he/she has lost faith or confidence in the Advocate. She/he has the right to change counsel. Once he/she clears the Advocate's professional bills, he is bound to provide an NOC and if the Advocate is not ready or reluctant to issue an NOC after clearance of the fees, then the litigent can apply to the court where the case is pending and pray for change the advocate, the court may allow the application post-hearing and after that, he/she can engage a New Advocate filing a fresh Vakalatnama in favour of new Advocate for representing his or her case before the Court. In the case of Chandra Shekhar Soni v. Bar Council of Rajasthan and Others [AIR 1983 S.C. 1012], the Hon’ble Supreme Court of India held that “It is not per se professional etiquette for an advocate while retained by one party to accept the brief of the other. It is unprofessional to represent conflicting interests except by express consent given by all concerned after a full disclosure of the facts. Counsel's paramount duty is to the client and where he finds that there is a conflict of interests, he should refrain from doing anything which would harm any interest of his client. Typically, such type of conduct on the part of an Advocate may be considered professional misconduct once a complaint is filed against the Advocate by the litigant/client under Section 35(1) of the Advocates Act, 1961 before the disciplinary committee of the State Bar Council. In view of the complex question of law and facts involved in your case, it is suggested to consult with an experienced Advocate preferably a Sr. Advocate of High Court or Supreme Court to navigate the issues effectively.
