Mutation based on possession by revenue court

Mutation doesn't create or extinguish title to the property. It simply reflects who is liable to pay land revenue. Mutation is the process of updating revenue records to reflect changes in ownership or possession of land. Revenue Courts are primarily concerned with administrative functions related to land revenue and do not have the jurisdiction to decide on matters of title or ownership of the property. The Civil Court has the primary jurisdiction to adjudicate matters related to the validity of the property titles/ownerships. The Revenue Court does not have the authority to adjudicate on these issues. The Hon'ble Supreme Court in the case of Partap Singh v. Shiv Ram, (2020) 11 SCC 242, held that the revenue record can be rebutted if such entry was made fraudulently or surreptitiously, or where such entry has not been made by following the prescribed procedure.
