Wakf Land Rent Dues After Fathers Death

The Chief Executive Officer of the Wakf Board can remove illegal occupants or tenants who are not paying proper dues under Section 54 of the Act. While you haven't "officially" taken over, your continued association with the shop and the fact that it was your family's business might make you a de facto occupant in the eyes of the Wakf Board, especially if no other arrangements were made after your father's passing.


While there's no formal agreement in your name, the Wakf Board might view you as a "tenant by sufferance" or an "unauthorized occupant" if the tenancy wasn't formally transferred or terminated. Your father's original tenancy, even if informal, created a relationship that doesn't automatically vanish upon his death, especially when it involves property.

You can request a waiver or negotiate the amount with the Wakf Board.

Wakf Boards often deal with such situations and may be open to negotiation, especially if you can demonstrate genuine hardship or a desire to either regularize the tenancy or surrender the property.
