Dear Sir,
When the Judge says "you, complainant, should conduct the enquiry," it doesn't mean you personally go out and investigate like the police. Instead, it means you are now responsible for:
Leading the Evidence: You will need to present your evidence to the court. This includes:
Your sworn statement: You will reiterate the facts of the case under oath.
Producing your witnesses: You will need to bring your witnesses to court for their examination by the Magistrate. Their statements will also be recorded on oath.
Submitting documentary evidence: Any documents related to the forgery (e.g., forged documents, bank statements, etc.) and the missing persons (e.g., missing person reports, last known contacts, etc.) will need to be submitted and proved.
Assisting the Court: You will be facilitating the Magistrate's inquiry by presenting your side of the story and providing the necessary evidence for the Magistrate to determine if there is sufficient ground to proceed against the accused.
