What legal remedy do I have if a Brand laptop fails multiple times
I bought an ASUS laptop on 31st Dec 2023 for ₹1,75,000 from an authorized store in Bhopal. First Failure: Within the first week of purchase, the laptop had a graphics card issue. I submitted it for repair and received a replacement unit after a few days. I lost my data due to this sudden failure. Second Failure: After around 8 months, the replacement laptop developed a display issue and then died. The service center took nearly 3 weeks to repair it as they received faulty spare parts multiple times. I again lost important work data due to the failure. Third Failure (Current): After 6 more months, the same unit again stopped working completely and is currently under repair. Again, they received faulty parts and there is no timeline for when the issue will be resolved. This is the third time I have lost my work data, which is impacting my professional productivity and causing mental stress. I also requested a home repair visit which was acknowledged by ASUS helpdesk but no technician came. I escalated the issue on Twitter/X, after which I got a call from an ASUS representative who took my details and promised resolution — but never followed up. I raised a complaint on consumerhelpline.gov.in, but ASUS simply replied that the issue was repaired and returned, and the platform marked the case as closed without resolving my request for compensation or acknowledging the repeated failures. I now want to file a case on e-Daakhil and request ₹60,000 as compensation for 3 major hardware failures, repeated data losses, emotional distress, poor service, and professional disruption. My questions: - What legal remedy do I have now under the Consumer Protection Act? - Is compensation of ₹60,000 reasonable for the issues and data loss I faced? - Will I need to attend a hearing if I file through e-Daakhil? Kindly advise how strong my case is and the next legal steps.
