hello sir, i want to know that if i don't have any proof of my husband's monthly income then how will i get my monthly maintenance by court

Bhojappa Kallihala

Responded 4 years ago

A.Dear madam, if you want monthly maintenance then you have option to approach to court by filing petition under section 125 of CrPC. You are required to make application under section 91 of CrPC in the petition for summoning the salary certificate from his employer. The Court will issue notice to his employer to submit the salary certificate. On that based the court will decide the case.

A.You put one high figure like one lakh or so and seek the court to grant half of his monthly income. Your husband will file his monthly salary slip stating that his income is not so high. burden is on your husband to show that he has been not earning such high amount and proves to the satisfaction of the court that he is earning only such less amount which he is earning monthly. Other wise you can summon the pay officer to the court asking him what is the monthly salary of your husband.
