If a respondent fails to file an affidavit or appear before the court within the stipulated time, the court may, upon the petitioner's request, proceed ex parte after hearing the petitioner's submissions and evidence. The court may only proceed ex parte if the respondent fails to cooperate after due notice and opportunity. So, in the given scenario, despite receipt of court notice, when the respondent fails to appear and submit affidavits, the petitioner can file an application(IA) before the Court praying for ex-parte hearing of the writ petition based on the subimissions and affidavit filed by the petitioner.
