Transfer in maternity leave

Maternity Leave Continuity:
Your maternity leave continues for the full sanctioned duration (e.g., 180 days as per CCS Leave Rules) unless you choose to join duty early and inform the authority in writing.

No Need to Re-Apply for Leave:
Since your leave was already sanctioned, you do not need to re-apply unless there is a change in leave duration or a requirement by your new school-in-charge to resubmit papers for recordkeeping.

Unless the transfer or joining in new place of posting affects your maternity rights, it does not play any role while an eligible woman employee who joins at the new place of posting on her own volition while on maternity leave. The duration of maternity leave for both first and second-time mothers is 6 months or 26 weeks. This leave can be availed either before or within 6 months from the child's delivery date. Once a woman employee applies for maternity leave, the establishment is duty-bound to approve her leave and disburse to her all the monetary benefits available under the Act. When a woman employee is on maternity leave, even if the employer issues a transfer order, that becomes effective from the date the employee resumes her job either before or on expiry of maternity leave. However, in case the employee resumes before the expiry of the maternity leave, she has to submit a medical certificate declaring her fit to resume her job. It's illegal for employers to discriminate against a woman employee based on her employment status or pregnancy status affecting her maternity right.
