Wrong Item sold on Amazon Refurbished item sold as new

I have purchased a mobile from amazon in april. The screen got damaged automatically so i visited service center where i got to know that the mobile is an overseas product and is also refurbished which amazon sold me as new with complete amount of new and did fraud with me

Send a Legal Notice (Optional but Effective)

Draft and send a legal notice to Amazon (and seller, if distinct).

Mention the date of purchase, invoice, issue faced, and demand refund/replacement + compensation.

Give 15 days’ time to respond.

In the given scenario, since the service provider (AMAZON) is providing their service to customers an online platform, a complaint against them over deficiency in service and unfair trade practices may be filed online mode through e-daakhil portal (https://edaakhil.nic.in/edaakhil/) introduced by the Consumer Affairs Department, Govt. of India following the provision of the Consumer Protection (E-Commerce) Rules, 2020 and the Consumer Protection(Direct Selling) Rules, 2021 claiming appropriate relief and compensation for harassment. Complaint should be filed within two years from the date of cause of action.
