If a case adjudicate or pending in consumer court then op can refer me to arbitration as per agreement clause

If a case will be pending in any court then the op can not refer me to arbitration on same matter or party because that matter will come under res judicata or may be res subjudice

They can refer that case to arbritration. Res Judicata is not applicable here.
Your concept on the same is not clear.
