Rule 24 of the U.P. Government Servant Conduct Rules, 1956 states that no Government servant shall except with the previous knowledge/consent of the appropriate authority, acquire or dispose of any immovable property by lease, mortgage, purchase, sale, gift or otherwise, either in his own name or in the name of any member of his family; Provided that any such transaction conducted otherwise than through a regular and reputed dealer require the previous sanction of the appropriate authority as defined under Rule 5 of the said Rule. So, the statement made by the Lekhpal appears to be in order. Public servants, like other citizens, have the right to inherit and own ancestral property. However, they are subject to specific rules and regulations regarding the acquisition and declaration of assets, including inherited property. So, to acquire the said property/land, you need to abide by the provision of relevant rule prescribed under the U.P. Government Servant Conduct Rules, 1956. However, post retirement from government job, the said rule is not applicable on the Govt. Servant or his family members.

What Matters Legally:

Possession and Use: If your grandfather lived and possessed the land continuously for decades (especially before 2005), this may be treated as

possessory title or basis for regularization.

Abadi Land Rights: In Uttar Pradesh, under land revenue rules:

If a family has occupied abadi land for years (especially before 2005), they may apply for regularization.

For Gaon Sabha (village common) land, long possession can be regularized under certain government schemes.

Partition Claims: If there was a family partition, and this portion was allotted to your side, then even without title papers, you may claim
occupancy rights.
