The laws protecting women’s rights in India include the Dowry Prohibition Act, 1961, the Protection of Women from Domestic Violence Act, 2005, the Hindu Succession Act, 1956 as amended in 2005, the Maternity Benefit Act, 1961, the Indecent Representation of Women (Prohibition) Act, 1986, the National Commission for Women Act, 1990, the Medical Termination of Pregnancy Act, 1971, the Equal Remuneration Act, 1976, the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the Prohibition of Child Marriage Act, 2006. So, it has now become a cumbersome and tiresome exercise to prove any complaint of harassment against women who are now well-protected by the laws of the land. However, she being your office colleague, you can share your ordeals and harassment with your boss in confidence to resolve the issue. In case, being aggrieved with your action, if she brought a complaint of sexual harassment under the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, also known as the PoSH Act, then you can defend the complaint before the ICCs (Internal Complaints Committee) taking the recourse of Section 14 of the said Act that addresses the penalties for filing a false or malicious complaint and providing false evidence. In that scenario, the ICCs (Internal Complaints Committee) may initiate the departmental inquiry into the allegation and recommend to the employer that action be taken against the woman employee or the person who filed a false complaint following the provisions of the service rules of the establishments. However, in case, the ICC did not carried out any inquiry against the false complaint or allegation, you can bring the matter to the notice of of the District Magistrate or ADM, who is designated as the District Officer of the Local Complaints Committee(LCC) under Section 5 of the POSH Act for redressal of your grievance/complaint.
