Department of Higher Education, Ministry of Education, Government of India has issued new guidelines for the coaching centers applicable to all the states across the country from January, 2024. As per New Guidelines, no coaching centers are allowed to provide admission to children under 16 years of age. The coaching fees for unique courses being charged must be affordable. The receipts for the fees charged have to be made available to students. As per new guidelines, if the student has paid for the course in full and is leaving the course midway before the prescribed period, the student shall be refunded from out of the prices deposited in advance for the final time, on a pro-rata basis within 10 days of application, if the student is staying in the hostel of the coaching center, then the hostel costs and mess rate, and so forth. In the given scenario, since the service provider is providing online service, after serving a legal notice to them, a complaint needs to be filed against them for deficiency in service and unfair trade practices online mode through e-daakhil portal (https://edaakhil.nic.in/edaakhil/) introduced by the Consumer Affairs Department, Govt. of India following the provision of Consumer Protection (E-Commerce) Rules and Consumer Protection(Direct Selling) Rules, 2021 claiming a refund of coaching fees along with compensation for harassment and cost of litigation. It may work faster to redress the complaint. Futher, in case any branch of coaching centre is in operation or running in your district, you can file your complaint online mode before the District Consumer Commission within TWO YEARS from the date of the cause of action, i.e, the date of denial of any relief by the service provider.
