In the absence of any offer/appointment letter that governs the relationship between an employer and employee, you may not be deemed to be an employee of the employer and accordingly there exists no obligation on the part of employee to comply with any terms of employment. You are free to leave your job any time with a simple notice to the employer without observing any formalities. As regards your payment of salary for the days you were involved in the company’s work, you may approach your employer for payment of the same post-resignation and in case of refusal, if you possess any authentic documents that supports your claim then serving a legal notice to the employer, you can approach the concerned Labour Commissioner for a resolution in the matter, failing which, you can file an application under Section 33(C(2) of the Industrial Dispute Act, 1947 before the Labour Court concerned claiming your dues from the employer, provided you are a workmen as defined under Section 2(s) of the I D Act, Otherwise, you have to file a civil suit(money suit) before the Civil Court seeking appropriate relief in the matter. If required, consult or hire an Advocate to navigate the issue effectively.
