Divorce and mitigation
I was married since 2015 and have 2 sons 8 and 5 year kids.My husband is chronic alcoholic and abusive i had sufferes his torture for sake of my kids. But he used to behave violently with kids too.I had filed for divorce 2024 and case status is at ex parte hearing and he filed section 9 after he received first notice of divorce. Since last 1 year my husband did not come for any hearing. But now he had applied for mitigation so that he wants to neet kids. Neither me nor kids want to meet him. When we were with him, he never cared about us neither take any responsibility. H e use to torture my kids consider them as burden did not even send them to school. After drinking alcohol he just want to have have physical with me, whenever i ignore he use to torture me and does not allow me and kids to sleep peacefully. Even my elder son started ignoring his father when he was with him, due to his behavior during my absences my husband used scold and treaten my elder son saying staying at my home and eating my shit you are ignoring me. During exparte hearing and evidence filling i had submitted half evidence at court another half was able to submit because his advocate had submitted his fake medical certificate. Please advice does court advice visitation for such father and what to do further as i wish to submit important evidence and what to be expected during mitigation. I missed to mentioned the advocate who had taken my husband case was my first advocate i had try to filed divorce in 2023 with my first advocate, but i don't what happen she started supporting my husband and family did not filed the case for 6 month and fooled me. After 6 month I started taking other advocate advice and checked in court my divorce and dv both were not filed till april 2024. When i came i asked my first advocate she said my husband had asked her to not proceed for divorce and DV. I withdraw my case from her and given to other who is now handling my case. But now my firts advocate is supporting my husband and family and filed section 9 against me. No action can be taken against that advocate and my husband
