I have been married since 7 months, the guy whom i got married cheated me by faking information about his salary, education and family involvement with regard to our marriage. He is also faking about his duty hours daily and not coming home after marriage. His relative has stated that he has plans to divorce me and get married to someone else and he is not getting any money from me or my family. What legal action (penal code) can be taken against him and his mother and sister who are involved in this case? Please let me know if this falls under fraud or cheat penal code

A.Mom,
It is a good case and seek criminal remedy before the court.Lodge complaint before police station and produce your evidences before the police and they can file a FIR.

A.When you say cheated you then you have to bring the evidence that what he previously said or presented to you which are wrong now. Usually in marriages it is difficult to prove these kind of allegations and if proved then you can go for nullity of marriage through court.
Getting him and his family behind the bar due to this is rather difficult task. You can discuss all you matter with lawyer to evaluate where do you stand.

Thank you so much for your advice. Well so I have been legally married to him and I have documents stating that are being legally married to my husband however the issue is not about nullifying my current marriage the issue is more got to do with the way he behave and the way there indirectly harassing me and threatening me if I don't give money. On the other hand they are also telling that they will not take money from me but they want him to give money to his family he has already taken loan and given sufficient money for his sister's marriage and he has also given a house for his mother to stay where he is paying the rent for the house. But now he gets hardly 10000 rupees a month after deduction of all the loans and the HRA. His mother states that he is not given any money and is asking for the remaining 10000 which is earning this is becoming difficult for me to manage expenses because I am not working currently. I would also like to inform you that my mother has given me a house to stay with a vehicle for me and for my husband to travel and she has also provided food and whatever other expenses are there at home including electricity bill and servant will is been taken care by my mother even after marriage.

A.The limitation under criminal law is just a reasonable time, and under civil it is 3 years.

A.If you were led to believe by what they all had told you and married him, you sure had a cause of action against all those under civil and crminal Laws. But you should take legal action within a certain period after coming to know of the cheating.

The problem is he has lied to me stating he did not get his salary for 10 months and he also lied to me about his educational qualification stating he has completed his diploma but I believe he is not completed that. He also stated that his mother will live with his sister after marriage but the things turned out to be different now the issue is he does not turn back home and he starts dodging me only if I provide money he comes to me otherwise he doesn't come to me. His family states that he has the loan of 3 to 4 lacs for his sister's marriage and if I actually see the records I see that they only have a loan of 10000 Rupees which has to be given back. If at all I live in his house for a day or two or for a week I am ill treated by not giving food and I will have to sleep on sofa without any Comforts and my husband states that if I have to live with him I'll have to live in his house. However prior to a marriage he agreed to live with me alone in my house now the statement is becoming the other way
