Two wheeler finance fraud
Subject: Complaint Against Dealer & TVS Finance for Fraud, Deficiency in Service, and Unfair Trade Practices --- Facts of the Case: 1. Illegal Vehicle Delivery Vehicle delivered on 16/08/2025 without valid finance, insurance, or temporary registration. Loan and insurance processed only on 18/08/2025 (17:45 hrs), and TR issued on 22/08/2025. This is a violation of Motor Vehicles Act, 1988 (Sec. 39 & 192) which prohibits delivery/use of unregistered vehicles. Also amounts to deficiency in service under Consumer Protection Act, 2019 (Sec. 2(11)). 2. Down Payment Irregularities Paid ₹18,500 (₹15,000 + ₹3,500) DP. Receipt issued carried invalid GST details and invoice was signed by staff, not dealer. Violation of GST Act, 2017 (Sec. 122 – issue of false invoice). Fraudulent billing = unfair trade practice under Consumer Protection Act, 2019 (Sec. 2(47)). 3. Finance Irregularities Vehicle model mismatched in loan documents. Loan amount inflated beyond agreed terms. Hidden charges (processing fee, stamp duty, etc.) not disclosed. Violation of RBI/NBFC Fair Practices Code, and misrepresentation punishable under Indian Contract Act, 1872 (Sec. 18 & 19). 4. Personal Data Misuse Finance executive took my phone, accessed OTPs and links without consent. Violation of Information Technology Act, 2000 (Sec. 43A & 66C – misuse of credentials, data theft). Also violation of Right to Privacy (Supreme Court Judgment: Justice K.S. Puttaswamy vs Union of India, 2017). 5. Medical Harassment Continuous harassment and stress from dealer/finance irregularities led to health issues. Claim under Consumer Protection Act, 2019 (Sec. 2(9) – compensation for harassment, mental agony, and health loss). Evidence Available: 1. UPI transaction history. 2. Receipts & invoice with irregularities. 3. Call recordings (dealer/finance executives). 4. Eyewitness testimony (father). 5. CCTV footage from showroom. 6.
