The EWS reservation was introduced through:

Constitution (103rd Amendment) Act, 2019, and

DoPT Office Memorandum (O.M.) No. 36039/1/2019-Estt (Res) dated 31 January 2019.

These guidelines apply to all Central Government recruitments and admissions (UPSC, SSC, banking, etc.), and most States follow the same model with small variations.

Your in-laws’ pension or income will not be counted for determining your EWS eligibility, since you are married and living separately.
Only your husband’s income (and yours, if any) will be taken into account.

A married woman's EWS eligibility is assessed based on the combined income of her husband and his family. To be eligible for the EWS certificate, she will have to satisfy all the following conditions: 1) she should be a ‘general’ candidate (not covered under reservation for SC, ST, or OBC). 2) Her husband's family’s gross annual income should be below Rs. 8 lakhs. This includes income from all sources, such as agriculture, salary/pension, business, etc., for the financial year before she applies for the certificate. 3) Her husband's family should not own agricultural land of size 5 acres or more. 4) Her husband's family should not own a residential flat of an area of 1000 square feet or more. 5) Her husband's family should not own a residential plot (in notified municipalities) of an area of 100 square yards or more. 6) Her husband's family should not own a residential plot (other than in notified municipalities) of an area of 200 square yards or more. The land or property owned by the family in different locations should be clubbed while checking the eligibility conditions for EWS category reservations. So, given the conditions of eligibility, if you qualify for all these eligibility criteria, including the income criteria, you can apply for the EWS Certificate.
