What Your Society Is Doing Wrong
Charging Rs 8/sq.ft. for residential and Rs 5/sq.ft. for commercial without General Body Resolution and Registrar approval violates Bye-Law 70.
Maintenance cannot be arbitrarily different unless special services are provided exclusively to one class (e.g., air-conditioning, exclusive lift, etc.).
Charging ₹12,000 extra per month for watchmen/security only from commercial units — while the same gate is used by everyone — is unjustified and discriminatory.
Violates Bye-Law 70(d) and Section 73(1AB) of the MCS Act (society must act fairly towards all members).
Only if the commercial members had an exclusive entry or dedicated service could such a cost be allocated separately.
Approach the Deputy Registrar of Co-operative Societies
If the committee refuses or ignores your complaint, file a formal grievance to:
Deputy Registrar of Co-operative Societies (your ward’s jurisdiction)
Office of the Deputy Registrar, Co-operative Housing Societies,
(e.g., Andheri / Borivali / Kurla / etc. for Mumbai region)
Ask for:
Enquiry under Section 83 of MCS Act (irregularities & misappropriation).
Direction under Section 79A to ensure uniform charges.
