Dear Client,
Once a cybercrime scam involving suspicious or fraudulent transactions is reported online to the National Cyber Crime Reporting Portal(NCCRP) or calling the number 1930 or an FIR is lodged in local police station, on the instruction of the Cyber Crime Cell, the investigating team starts the routine process of investigation immediately freezing the suspected accounts linked to fraudsters and the victim's Bank account obtaining an order from the court of Magistrate under Sec.102 Cr.PC(now Section 106 BNSS) to that effect. You have to wait for the completion of the investigation of the cyber scam by the investigating agency to get your account unfrozen and get back your lost money. In the course of the investigation, you may be interrogated by the police or the IO of the Cybercrime Cell to access or identify the source of the fraudulent transactions. The length of time it takes to investigate a cybercrime can vary greatly depending on the complexity of the case, the resources available to the investigators, and the cooperation of the victim. You can check the updated status of your complaint online. Be prepared to provide any information or documents requested by the bank or the cyber cell related to your account transactions and gather evidence like receipts, transaction details, or communication logs that support your claim. Keep in touch with both the bank and the cyber cell to track the progress of the unfreezing process. For non-cooperation from the investigating agency, you can escalate your grievance to the Higher Authorities, i.e, the State Police Complaint Authority or the Chairperson, State Human Rights Commission to speed up the investigation into the reported scam. However, in the course of an investigation, when an amount is traced out and put on hold, the victim can move a petition under Sec.. 457 of Cr. PC before the court of Magistrate, praying for the release of the said amount. Section 457 of the CrPC empowers a Magistrate to use their discretion to order the conditional release of the amount frozen or put on hold under a cyber-scam. If you encounter difficulties or need assistance with the legal procedures, consult with a cyber-expert or a lawyer specializing in cyber and banking law to navigate the issues effectively.
