Scammers/fraudsters often lure people into investing in fraudulent schemes by impersonating their identities to investors. Before any financial investment in a security or financial company, investors should check the ins and outs of that company to protect their investment from gambling. These types of fraud conducted on Telegram/Instagram/WhatsApp often include financial scams, phishing attempts, and other types of activity targeting users to provide their personally identifiable information (PII). Section 66A, Section 66C, and Section 66D of the Information Technology Act, 2000, explicitly criminalize the acts of online harassment, identity theft, and deception. In that scenario, being a victim of a fraudulent transaction, you should immediately report the incident online at https://www.cybercrime.gov.in to the National Cybercrime Reporting Portal (NCRP) or the National Cybercrime Helpline at 1930, or you can complain to the local police station to freeze the scammer accounts and to protect yourself from further financial loss. Apart from this, you can file a private complaint against the person/s in the court of the Judicial Magistrate under Section 223 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, which outlines the procedure for a Magistrate to take cognizance of an offense. Upon receiving a complaint, the Magistrate shall examine the complainant and any witnesses present. This examination is conducted under oath, and the substance of the examination is documented and signed by the complainant, witnesses, and the Magistrate. If the Magistrate finds sufficient grounds for proceeding with the complaint, he may issue a summons or warrant to the person under Section 227 of the BNSS, 2023. Under Section 207 of BNSS, the Magistrate is also empowered to issue a summons or warrant for an offense committed beyond local jurisdiction.
