A reply to an RTI application made under Section 6(1) of the RTI Act, 2005, is typically provided within 30 days of receipt by the public authority under Section 7(1) of the Act. However, in the case that the information sought is related to another department of the public authority, the application must be forwarded to the concerned public authority within 5 days of receipt, as per the provision of Section 6(3) of the Act, forwarding a copy to the applicant. If no decision or information is received within 30 days from the PIO, then the application may be deemed refused or denied. In that scenario, the applicant should file the first Appeal to the first Appellate Authority(FAA) within 30 days under Section 19(1) of the Act, which is required to be disposed of by FAA within 30 days of receipt of the Appeal and failing which applicant should file second Appeal under Section 19(3) of the RTI Act before the Central Information Commission or the State InformationCommission within 90 days post 30 days of filijg first appeal. Given the provisions of the governing law and the time frame prescribed for reply to an application by a public authority, when no reply or response is received after the lapse of two months (30(PIO) + 30(FAA), you can now file your 2nd Appeal under Section 19(3) of the Act to the CIC/SIC within 90 days seeking the desired information.
