Dear Client,
It appears that you are a victim of unfair trade practices of so-called real estate Brokers/Agents. After the enactment of the Real Estate (Regulation and Development) Act, 2016, all real estate agents/brokers are mandatorily required to register themselves with the RERA under Section 9 of the Act and the functions or activities of all real estate agents/brokers in the real estate business are regulated under Sec.10 of the said Act. Each state in India has its own RERA portal, and these portals typically provide a section for viewing registered agents. By accessing the official RERA website, you can ensure that the agent or broker you are working with is registered under RERA. In the given scenario, serving a legal notice to the Broker, you can file a complaint against him over deficiency in service and unfair trade practices before the RERA, seeking appropriate relief in the matter. You can also file a money recovery suit against the said broker within three years from the date of the cause of action, provided you are well equipped with the evidence of transactions of money held between you and the broker. If necessary, consult or hire an Advocate to navigate the issue effectively.
