Unless the Court pass an order of stay specifying that the delinquent employee shall continue with the allotted staff quarter till the disposal of civil suit, the employer would follow its own rules applicable in case of termination or dismissal of an employee from the service that ceases the relationship between the parties. A terminated employee does not have an automatic right to retain their employer-provided accommodation until the disposal of a civil suit challenging the termination. If the employee does not vacate voluntarily after the notice period, the employer should follow due process to evict them for unauthorised possession by filing an eviction suit in the competent Court, but cannot forcefully evict the terminated employee without a court order. The terminated employee can seek an injunction from the court to stay the eviction while their termination suit is pending. The court will decide based on the merit and specific facts and circumstances of the case. Hence, it is highly recommended to consult with a legal professional to understand the specific rights and options based on the applicable laws and employment contract.
