Transfer of SC-ST land to General category

In UP, under Section 157-A of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950, the transfer of SC/ST land to the general category is restricted and requires prior written permission from the District Magistrate (DM). This restriction applies irrespetive of size of plot, as it aims to protect the land ownership rights of marginalized communities. An SC/ST landowner must get written permission from the District Magistrate before transferring their land to a general category individual failing which, such transfers can be declared null and void by the courts. Approval is granted in exceptional cases where a genuine need is demonstrated, or if the land is no longer used for agriculture and is deemed transferable under certain conditions. In some cases, land conversion may allow easier transfer, but this also requires approval from local authorities.
