Emrs rejoin rules

However, be informed that the relationship between an employer and employee is governed and regulated by the terms and conditions as outlined in the offer or appointment letter accepting which an employee joins in her or his assigned position in an organisation. The employees of Eklavya Model Residential School (EMRS) are governed by the rules and policies framed by the National Education Society for Tribal Students (NESTS), an autonomous body under the Ministry of Tribal Affairs, GOI.. As per guidelines issued by the NESTS vide its OM/Circular dated 26/07/2024, clause vii, prescribed the procedure for acceptance of resignation of EMRS employees and states that Societies are empowered to accept the resignation in respect of all employees other than the principal. Intimation to be communicated to the NEST immediately after accepting the resignation and relieving the concerned employee/staff. If an employee has resigned and wishes to return, the case must be referred to the NESTS headquarters for a decision. The local authorities (EMRS or State Societies) are not empowered to allow a resigned staff member to re-join on their own authority. The provisions of the CCS (Conduct) Rules, 1964 are applicable to all the employees of the NESTS and violation of these rules shall make an employee liable face disciplinary action under the CCS (CCA) Rules, 1965. There is no provision for re-joining or re-employment of EMRS employees post acceptance of their resignation and issue of relieving letters as per service rules framed by the NESTS. However, in the given scenario, you may approach the Commissioner/Joint Commissioner or Deputy Commissioner, NESTS for review or reconsideration of your application for re-joining/re-employment which exclusively depends upon the discretion of the authority.
