There are currently eight states with their two-child policy, such as Madhya Pradesh, Telangana, Andhra Pradesh, Assam, Maharashtra, Gujarat, Rajasthan, and Odisha. In Madhya Pradesh, Telangana, and Andhra Pradesh, a person with more than two children cannot contest in local elections or hold public office. In Maharashtra, people with more than two children are not eligible for government jobs since 2006, while in Gujarat and Odisha, they cannot be members of local government bodies. The Assam Government in the year 2019 approved a policy that will make those with more than two children ineligible for government jobs from January 2021 onwards. In a recent judgment, the Supreme Court upheld the decision of the Rajasthan Government to disqualify a candidate from applying to a police constable post for having more than two children. The Court held that Rule 24(4) of the Rajasthan Police Subordinate Service Rules, 1989, which provides that “no candidate shall be eligible for appointment to the service who has more than two children on or after 01.06.2002. The rule disqualifying a candidate having more than 2 children from the Government Job doesn't violate the Constitution of India. However, there are certain exceptions to it. Suppose you have got a single child from the first delivery and then twins from the other delivery, you'll be exempt from the above-mentioned condition. Another relaxation is that if a person has two children from the first marriage, which is dissolved legally, and then from his second wife, he has one child, then he'll be given relaxation. Again, if out of three children, one is impaired. So, considering the rulings of the Supreme Court and state-specific legislation, you may seek clarification in this regard either from the concerned department of the State Govt. or from the Department of Personnel and Training(DOPT), Ministry of Personnel, Public Grievance and Pensions, Govt. of India.
