In fact, a mentally disabled person is well protected by the laws of the land. The primary laws governing the rights of mentally disabled persons are (1) Guardians and Wards Act, 1890 (GWA); (2) National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (NTA); (3) Rights of Persons with Disabilities Act, 2016 (RPWD); and (4) Mental Healthcare Act, 2017 (MHA). However, in extreme situation, you can seek intervention of police and the court of Judicial Magistrate who on receipt of police report, can pass an order for a medical examination of the mentally disabled person and, if necessary, a "reception order" for detention of the person in a psychiatric hospital for treatment, if satisfied by the Magistrate that it is necessary for the person's health and safety or the protection of others living around the said person. You can also escalate your grievance before the Public Grievance Cell of the District Magistrate office seeking their intervention to resolve the matter and if required, seek help from the concernd NGOs that render dedicated services to the mentally disabled person to resolve the issue.
