Using or creating a fake birth certificate in India is illegal and carries significant legal consequences once the matter is brought to the notice of the concerned authorities. There is no provision under any law that authorises or can authorise for cancellation of a registered birth certificate under any circumstances, even if it is a fake certificate created or generated by default. To cancel the fake one, you have to gather all necessary documents, including your original birth certificate and any supporting proofs like your hospital record or school certificates. Then, you need to visit your nearest police station and file a written complaint stating that a fake birth certificate is generated unintentionally by default and now wish to cancel it. Attach copies of both the real and fake certificates to your complaint. The police will either register a General Diary (GD) entry or a Non-Cognizable Report (NCR) to officially record your complaint. In the given scenario, since you have no alternative, you have to apply to the Registrar under the Birth and Death Registration Act, 1969, praying for cancellation of the fake birth certificate, explaining the reason behind its issue in detail. In some cases, Registrar may ask for an Affidavit from the applicant to process the application. For updated information, you can visit the office of the concerned authorities to navigate the issue effectively. Recently, the Hon'ble High Court of Karnataka has directed the State government to issue appropriate orders to Registrars of Births and Deaths to cancel the earlier birth certificate while issuing a new one after correcting errors.
