Correction in high court judgement for names

You must file:

APPLICATION UNDER SECTION 152 CPC for correction of clerical/typographical errors) OR I.A. UNDER SECTION 151 CPC (if the error is not purely typographical but is non-controversial).

You file the I.A. in the same disposed case, before the same Bench, at the Karnataka High Court, Dharwad Bench. The I.A. gets a new IA number but is tagged to your old case.

If the correction is simple and clerical → Court may correct without notice. If the correction affects substantive rights → notice will be issued.

Under Section 152 of CPC, clerical or arithmetical mistakes in judgments, decrees or orders or errors arising therein from any accidental slip or omission may at any time be corrected by the Court either of its own motion or on the application of any of the parties. So, file an application under Section 152 of the Civil Procedure Code (CPC) mentioning the case details and the specific error before the concerned bench of the High Court that passed the judgement praying for correction of clerical/accidental errors apparent on the face of the record, attaching the certified copy of judgment, paying court fees, filing an affidavit, and serving notice to the other party; the court can then correct the error itself or decide after hearing the parties. If required, consult with an Advocate to navigate the issue effectively.
