I have made an agreement of Sale to purchase a house from agreement holder person B who have bought this house one month back from owner person A through agreement of sale by paying the
total sale consideration. But personal B wanted to sale this house due to some financial problem and the property is not register to person B.
This property is clean and the person B told that he will get the sale deed registered in my favour directly from Owner person A.and will hand over all the original documents including the agreement of sale with owner person A.

But the payment has to be made to person B. For my IT Returns how can I show that I have paid sale consideration to person B and not to OWNER PERSON A.

Is there any legal document like affidavit to be made between me and person B.

Please advise.

A.dear client in your matter i agreed on advice given that There are many points that you have stated in your post. Firstly, you have mentioned that the sale consideration of the entire amount has been paid by B to A. If, the sale consideration has bee paid then the ownership of the house is with B but if the registration of the house in not competed then the ownership is with A, because in case of immovable properties, documents means everything. In my opinion, you should, get the title ship verified first and then make any payment because if money is given once then you will be in big trouble of anything comes out negative.

A.You must have taken a signature of the owner to the agreement of sale by the agreement holder. Even if the sale deed is executed by the owner directly to you, Sale deed can be drafted including the agreement holder as a party to eliminate chances of his having created some encumbrance over it.
