The transfer of title or ownership of an immovable property devolves upon a person either through the law of succession post demise of the owner or through a sale deed or deed of gift paying requisite stamp duty while the owner is alive. To transfer a flat's share certificate to the donee of a registered gift deed in a society registered under the Maharashtra Co-operative Societies Act, 1960, the society must first verify the gift deed and other required documents. Then, the society's Managing Committee has to pass a resolution approving the transfer. Once approved, the society will endorse the donee's name on the share certificate and update its records, and inform the Registrar of Cooperative Societies. In case of registration of a gift deed with the Sub-Registrar to change or transfer the ownership of a flat/apartment in a cooperative housing society registered under the Maharashtra Co-operative Societies Act, 1960, a NOC from the Society is required in addition to all other documents.
