My landlord gave his flat on rent December 2018 and shifted to Gujrat and he promised we can stay minimum 2 years in the flat and there is no agreement between me and my landlord. We asked multiple times for agreement but he not written any agreement and suddenly this month 13th he called and said he got transferred to pune and want us to vacate flat immediately or with in 15 days. But my and family are out of city from last 15(before owner intimation). Now owner daily calling and asking us to vacate and harassing us. I want more time to vacate flat and also don’t want any harassment from owner until we vacate the flat. Could you please suggest, can I file a civil case against my landlord? If yes, please help me in that.

A.do not evict without a court order.

A.Dear Sir,
Nobody can be evicted without due course of law means ask the landlord to file suit for eviction and get Court order.

We don’t have any legal agreement between me and my owner so can I ask my owner to file suit for eviction? Or can I also file suit as tenant?

A.Sir try to solve it amicable no need to approach to the court. Because u both are nothing any documents in ur fever or owners fever

A.Hello,
You can definitely file a case against the harassment of the owner to vacate the flat. There's a certain procedure that you need to follow to protect your rights and interest from the owner.
Please take advise from a local lawyer to guide you thoroughly.
