Property law question
I need advice under Indian law. My father owns a restaurant, and a buyer agreed to purchase it for ₹15 lakhs. The buyer paid ₹8 lakhs as advance and a written agreement was executed. As per the agreement, the buyer was required to pay the remaining amount within three months. However, before completing the payment, the buyer backed out of the deal and demanded a refund of the advance. Despite this, and after a serious dispute, my father returned ₹2 lakhs in cash and issued a cheque for the remaining amount under pressure. Now, the buyer is threatening to file a legal case. We have the signed agreement in hand. Based on these facts, who is legally in the right, who is likely to benefit under Indian law, and what steps should we take next?
