Most common reasons behind the repudiation/rejection of motor insurance claim includes - Violation of policy terms, False declarations - providing incorrect information during policy purchase or claim intimation, Expired policies- If your policy has lapsed and a claim is made, it will likely be rejected, Unauthorised repairs- getting the vehicle repaired without insurer approval, especially for cashless claims, Delays in documentation- even valid claims may be denied if required paperwork is not submitted on time. However, as per the IRDAI(Protection of policyholder’s interest) Regulations, 2017, if your Car Insurance claim is rejected, the insurer must communicate the reasons in writing to the policyholder. As per clause 15 of said regulations, a copy of the surveyor’s report shall be furnished by the insurer to the insured/claimant, if he so desires. If the insurer, for any reasons to be recorded in writing and communicated to the insured/claimant, decides to reject a claim under the policy, it shall do so within a period of 30 days from the receipt of the final survey report and/or additional information/documents or the additional survey report, as the case may be. Where the claim is rejected, the insurer shall give the reasons for the same in writing drawing reference to the specific terms and conditions of the policy document. 10. In the event the claim is not settled within 30 days as stipulated above, the insurer shall be liable to pay interest at a rate, which is 2% above the bank rate from the date of receipt of last relevant and necessary document from the insured/claimant by insurer till the date of actual payment. Every insurance company in India must have a designated Grievance Redressal Officer (GRO). Submit a formal written complaint to the GRO, mentioning your policy number, claim details, and objections. The IRDAI mandates that insurers acknowledge complaints within three days and resolve them within fifteen days. If the insurer doesn’t respond within 15 days or the solution is unsatisfactory, escalate the matter via the Bima Bharosa System, IRDAI's official grievance redressal portal. If no resolution is reached, you can approach the Insurance Ombudsman for free and impartial redressal, failing which you can file a complaint before the Consumer Forum seeking appropriate reliefs along with compensation for harassment. The complaint before the District Consumer Commission should be filed within two years from the date of cause of action, i.e, from the date of repudiation of your claim by the Insurer.
