Dear Client,
You may not be entitled to cancel your admission midway of the course, in there exists no provision for cancellation of the admission in the policy of coaching institute/centre. So, review the terms and conditions of admission to claim it as a matter of right. However, be informed that the Department of Higher Education, Ministry of Education, Government of India has issued new guidelines for the coaching centres applicable to all the states across the country from January, 2024. As per New Guidelines, no coaching centres are allowed to provide admission to children under 16 years of age. The coaching fees for unique courses being charged must be affordable. The receipts for the fees charged have to be made available to students. As per new guidelines, if the student has paid for the course in full and is leaving the course midway before the prescribed period, the student shall be refunded from out of the prices deposited in advance for the final time, on a pro-rata basis within 10 days of application, if the student is staying in the hostel of the coaching centre, then the hostel costs and mess rate, and so forth. So, given the guidelines, when the coaching centre denied your appeal of cancellation of admission, serving a legal notice to the coaching centre, you can file a complaint against them for deficiency in service and unfair trade practice before the District Consumer Commission under the Consumer Protection Act, 2019 claiming appropriate relief along with compensation for harassment and cost of litigation. The complaint should be filed within two years from the date of the cause of action, i.e, from the date of refusal to a refund of tuition/coaching fees by the coaching centre. To remove an ECS (Electronic Clearing Service) mandate made for repayment of EMI against education loan from your bank account, you'll need to cancel it. This can be done either through your bank's online platform (if available) or by visiting a branch and submitting a written request. In case, despite your repeated attempts, if the bank is not responding to your appeal/grievance, you can file a complaint online to the regulatory authority, NPCI (National Payments Corporation of India) at https://www.npci.org.in/register-a-complaint. You can also raise your grievance against a Bank to RBI on its grievance redressal portal under the integrated Banking Ombudsman Scheme at https://cms.rbi.org.in for a quick resolution to the matter or on the Digital Complaint Management System (CMS) Portal: https://cms.rbi.org.in/cms/IndexPage.aspx. This is a unified portal for Banking, NBFC as well as Digital Transactions related grievances.
