Key Eligibility Criteria (Most Important)

You must satisfy ALL of the following:

(a) Residence

You permanently reside in a notified RBA area

Your village/area is included in the official RBA notification

Since you are residing in an RBA area in Kupwara, this condition is satisfied (subject to verification).

(b) Schooling

Schooling in the same or neighbouring RBA village is acceptable

There is no requirement that schooling must be in the same exact village

Your schooling in a neighbouring RBA village fully qualifies.

(c) Income Limit?

No income ceiling is prescribed for issuing an RBA certificate in J&K

Income matters only for EWS, scholarships, or fee concessions, not for RBA status

Family income of ₹14 lakh does NOT disqualify you.

As per J & K Government Social Welfare Department notification dated 25.10.2005, the eligibility conditions that qualify a person to apply for a Resident of Backward Area(RBA) certificate in the union territory of J & K are the annual income of a person claiming benefits under this category shall be determined in the following manner: i) where the Person is living with his/her parents/guardian and is dependent upon them/him, the annual income of parents/guardian from all sources(Annual family income should be less than Rs. 4.5 Lacs) shall be taken into account; provided that the income ceiling shall not apply to a person who has lived and completed entire school education from an area identified as Backward or Actual Line of Control, as the case may be, and in case such schooling is not available in such area, from the nearest adjoining area, ii) Where a person is not living with his/her parents/guardian and not dependent upon them/him. His/ her annual income from all sources, including that of his / her spouse, shall be taken into account. Provided that the annual income shall be assessed by taking into account the income of the last three consecutive years, excluding the agricultural income. In the year 2019, the Jammu and Kashmir government, in a big relief to the socially and educationally backward classes in the state, enhanced the income ceiling from Rs 4.50 lakh to Rs 8 lakh for them to avail of the benefits of reservation as per provisions of the Jammu and Kashmir Reservation Act, 2004. In view of the above, if your annual income exceeds the threshold limit of income required for the purpose, you may not be eligible to apply for a RBA Certificate.
