Dear Client,
A litigant should always be prepared with sufficient and cogent evidence that supports and establishes his or her complaint/claim against the opposite party in the courts. Gather documentary evidence and witnesses to prove the allegations before the court, irrespective of the social status or influence of the opposite party. Otherwise, in case the litigant fails to prove his/her allegations, he or she can face the criminal prosecution for making false complaint or adducing false evidence including punishments that include disciplinary actions leading to termination under POSH Act, 2013, plus potential defamation suits and imprisonment or fines or with both depending on the severity of crime as prescribed under BNS and BNSS, 2023. Hence, it is advisable to consult with an expert professional to understand your rights and remedies before taking legal actions.
