Women employees registered under ESI Act are equally eligible for maternity benefits as provided under the Maternity Benefits Act, 1961, if they contributed for at least 70 days in the two contribution periods preceding the benefit period and are entitled for 100% of average daily wages for the leave period and full medical care for pregnancy, delivery, and postnatal care at ESI facilities or cashless treatment at empanelled hospitals including a lamp sum amount for confinement outside ESI hospitals up to two confinements. Maternity Benefit is payable to an Insured Woman in the following cases, amongst others, subject to contributory status/conditions: 1. Maternity Benefit is payable for a maximum period of 26 weeks up to 2 surviving children in case of confinement, of which not more than 8 weeks shall precede the expected date of confinement, 2. The insured woman having two or more surviving children shall be entitled to receive maternity benefits during a period of twelve weeks, of which not more than six weeks shall precede the expected date of confinement 3. Sickness arising out of Pregnancy, Confinement, Premature birth-payable for a period not exceeding one month. Although your grievance about short payment of maternity benefits relates to five years back, you can still raise your grievance before the ESI authority and the Labour department of the State Government.
