The objective of the Compassionate Appointment Scheme is to grant an appointment on compassionate grounds to a dependent family member of a Government servant who has died while in service, regardless of the cause of death, or who is retired on medical grounds before attaining the age of 55 years (57 years for erstwhile Group ‘D’ employees). thereby leaving the family in penury and without any means of sustainable livelihood, so as to provide relief to the family of the Government servant concerned with financial destitution and to help it get over the emergency. The appointments on compassionate grounds were issued under the Department of Personnel & Training vide O.M. No.14014/02/2012-Estt(D) dated 16.01.2013, and are available on the Department's website. Under the Compassionate Appointments Scheme, employment is offered to any one of the legal heirs of the deceased Public Servant, including Wife, Husband, Son, Daughter, Divorcee, or Widowed daughter, if qualified for the same in terms of the rules of compassionate appointment. The eligibility for an appointment under the Scheme for Compassionate Appointment is updated on 02/08/2022 by the Department of Personnel and Training(DOPT), Ministry of Personnel, Public Grievance and Pension, Govt. of India, wherein the scope and eligibility for employment under the compassionate appointment scheme are explained in detail. Level 5 posts generally fall under Group 'C' in the Central Government departments. As per the OM dated 02/08/2024 of DoPT, appointments on compassionate grounds should be made only on a regular basis, and that too only if regular vacancies are available. Compassionate appointments can be made upto a maximum of 5% of vacancies falling under the direct recruitment quota in any Group ‘C’(Level 5) or ‘D’ post. The ceiling of 5% of direct recruitment vacancies for making compassionate appointments should not be exceeded by utilising any other vacancy. If sufficient vacancies are not available in any particular office to accommodate the persons in the waiting list for compassionate appointment, it is open to the administrative Ministry/Department/ Office to take up the matter with other Ministries/Departments/Offices of the Government of India to provide, at an early date, appointment on compassionate grounds to those in the waiting list. Compassionate appointment should not be denied or delayed merely on the ground that there is a reorganisation in the Ministry/Department/ Office. It should be made available to the person concerned if there is a vacancy meant for compassionate appointment and he or she is found eligible and suitable under the scheme. Be informed that the Supreme Court has also held in its judgment dated February 28, 1995 in the case of the Life Insurance Corporation of India vs. Mrs Asha Ramchandra Ambekar and others [JT 1994(2) S.C. 183] that the High Courts and Administrative Tribunals can not give direction for appointment of a person on compassionate grounds but can merely direct consideration of the claim for such an appointment.
