There is no specific criminal punishment or court imprisonment in India for failing to disclose to your current employer that you lack a relieving letter from a previous company where you resigned after just one month. Employment matters like notice periods and relieving letters are governed by civil contracts and labour laws (such as the Industrial Disputes Act), where the previous employer can only pursue monetary recovery for unserved notice pay through legal notice or civil suit no jail time applies to you.
Your current employer may terminate you if they discover the omission during background checks (treating it as misrepresentation), but this remains a civil employment dispute, not a criminal offence. Criminal liability (IPC Sections 420, 465/471 with up to 7 years imprisonment) arises only if you forge documents, not for mere non-disclosure of a short tenure.
