Sir/ Madam
One of my known friend has sent me legal notice in false allegation that he has given friendly loan to me of amount Rs 90000 in the year 2013, but in fact the amount he has credited in my Saving A/ c through cheque to give somebody for Land mutuation work of his own relative, the said amount was credited in my account to give the concerned person who had to do the Land work, but now aftr 5 years ,he is forcing me to return and sent a false legal notice of Friendy Loan, there is no promisonary note or aggrement for Loan , only charing me on basis of Amount credited, i have audio clip of the person whom i have paid the money .

A.dear client in your matter i agreed on advice give that Reply to the legal notice through your legal council with all the details and records and proof of payment to the person you have paid, your council will do all the legal formalities to protect your interest & liability quickly.

A.Reply to the legal notice through your legal council with all the details and records and proof of payment to the person you have paid, your council will do all the legal formalities to protect your interest & liability quickly.

Payment paid in cash to the person, no documentary proof only audio clip. Would it help?

No. Try if you can obtain receipt on revenue stamp & with two witness stating details of payment received and date on which is signed & witnessed.

But after 5years , how it could be possible to get it signed on hearing legal issue, he will deny for it and my known friend is charing claim on basis of cheque deposited in my account, i havnt signed any agreement or Note for the amount.

The only safe & sure way is to obtain a receipt, better to take help of a Lawyer to safeguard & protect you interest quickly.

A.U give reply to his notice by regd.post.stating all the facts.keep all the documents and audio clips safely, don't lost it.your friend. Cannot claim as per law

Sir, der is no written evidence of Loan , expect amount credited in account through cheque, and to whom i paid it through Cash, how would it help me to defend?
