Separation and divorce

my husband file a separation suit at Vadagaon court at pune and i am a helpless women . he knows that he will win on expertly decision due to non appearance of me due to financial condition. i am from Bolpur West bengal. please help i have received an e- court notice in my mobile. please suggest me what to do?

Ma'am,

As you cannot go to Pune then you will have to file an application fro transfer of case to Bolpur (Birbum Distrcit Court) for further adjudication. This transfer application needs to be filed in Supreme Court as the case will transferred from one state to another.
By the way why has he filed the case in Pune? Were you both living together in Pune or got married in Pune?

Dear Client,
You should not panic on receiving the e-court notice, as your husband cannot win the case merely due to your non-appearance.

Since you are a woman residing in Bolpur, West Bengal, and the case has been filed in Vadgaon Court, Pune, you have a legal right to seek transfer of the case to a court near your place of residence due to financial hardship and long distance, and courts generally allow such transfer in favour of the wife.

You should immediately approach a lawyer who can help you file a transfer petition and also move an application for appearance.
