Inclusion of different matter in one case

In general, it is not legally advisable to include multiple, unrelated issues in a single case, unless they arise out of the same transaction or a continuous chain of facts and the court has jurisdiction over all the issues involved.

If your primary dispute is non-payment of salary, that itself is a distinct cause of action and can be raised before the appropriate forum such as the Labour Court, Industrial Tribunal, or under the Payment of Wages Act / Shops and Establishments Act, depending on your employment status.

Allegations of illegal tax benefits or tax evasion are of a completely different nature. These fall under tax laws (Income Tax Act, GST laws, etc.) and are investigated by tax authorities, not by labour or civil courts in a salary dispute. Bringing tax-related allegations in a salary recovery case may be viewed as irrelevant, vexatious, or an attempt to prejudice the court, and the court may strike out those pleadings.

Legally, courts follow the principle that each cause of action must be tried in the appropriate forum. While facts that are incidental or directly connected to non-payment of salary (for example, false payslips, suppression of salary records) can be pleaded, independent misconduct like tax fraud should be pursued separately by filing a complaint before the Income Tax Department or other competent authority.

Therefore, the proper approach is to confine your case strictly to non-payment of salary and file a separate complaint or information regarding illegal tax benefits before the concerned tax authorities, if you have supporting evidence. This strategy keeps your salary case strong, focused, and free from unnecessary complications.
