Dear client,
This is a common issue, but it needs to be fixed systematically because a death certificate is a "terminal document"—it is very difficult to change once issued. In your case, your father was known as “Babubhai” socially, while his official records such as Aadhaar, ration card, and death certificate mention the name “Ali Ahemad.” Legally, the name appearing on the death certificate is treated as the primary and authoritative identity, as it is a statutory public document relied upon by courts, government authorities, banks, and revenue offices. Therefore, for all future legal and official purposes, it is advisable to use your father’s name as “Ali Ahemad.”
To resolve the discrepancy across documents, you should execute a “One and the Same Person” affidavit stating that “Babubhai @ Ali Ahemad” refers to one and the same person and explaining that “Babubhai” was a nick name. This affidavit, once notarised or attested by an Executive Magistrate, is generally sufficient to link both names and is widely accepted by authorities. You are not required to change all earlier documents; instead, for property matters, inheritance, banking, court cases, or government applications, you may use the name “Ali Ahemad” and attach the affidavit as supporting proof. Only in cases involving major disputes or high-value transactions may a Gazette notification be considered, though it is not mandatory in every situation.
